The University of Sydney collects Personal Information on behalf of itself and The University of Queensland.  Personal information you enter into the Website is governed by The University of Sydney Privacy Statement “Privacy at the University”.  Use of the Website implies Your acceptance of the terms of the University of Sydney  Privacy Statement.

Registered Users of the My Whiplash Navigator Website, are responsible for ensuring Your username, password and other sensitive information remains confidential to ensure no unauthorised access to Your account.  Your account should not be accessed by anyone other than You as all activity within the Website under Your account is Your sole responsibility.  In the event of unauthorised use of Your account You must inform us immediately by email via the Contact Page.  You also agree not to intentionally distribute viruses or any other technologies that may damage the Website or the interests or property of the Website’s users.

Should Your account be disabled You agree not to create another account and will not provide any false information. We are not responsible for any loss or damage to you or to any third party incurred as a result of any unauthorized access and/or use of your account, or otherwise.

Collection of personal and other information

The University of Sydney, acting on behalf of itself or The University of Queensland may collect personal information and other data about You from Your computer as You browse or otherwise interact with the Website. The various mechanisms used include server logs, proxy logs, and cookies. A cookie is a package of data which a website requests be stored temporarily on Your computer (or in memory) to identify You as a visitor to the Website. You can choose to disallow cookies by changing settings on your web browser. However, if You reject all cookies You may not be able to use some of the features on the Website.

The information collected by these various mechanisms includes:

  • the IP (Internet Protocol) address of the machine which has accessed the Website;
  • the dates and times of each interaction on the Website;

  • sometimes, the previous site visited and the type of browser used.

Cookies may also store the following information: session (numbered key) and duration. A numbered key is a unique server-generated number used to identify the current session. The session key can be linked back to Your unique identifier.

Unique identifiers are also used to store information about your preferences, to enable the dynamic display of the Website according to Your preferences when You return.

Information automatically collected by Us through the Website is held primarily by a third party service provider to store information in their systems. We have in place security measures based on a risk assessment process to protect against unauthorised intrusions and against the loss, misuse, and alteration of the information. We also encrypt some information.

Where You are a Registered User, You can access the Website only by using Your username/email address and password the information about You which is held, or You add or amend, on the Website, is protected by restricting access through that login. You must ensure that Your password is not disclosed or made available to others.

Our technical staff are able to access the logs created by servers for the purposes of collecting statistics, dealing with faults and improving the services offered by the Website.

Use and disclosure

Information collected by Us through automated mechanisms will only be used for the purpose for which it was collected in accordance with these Terms. We may provide your personal information to businesses both in Australia and overseas that assist Us to manage the Website and Your use of the Website (Service Providers). Use by Service Providers of Your personal information is limited to purposes which enable Your use of the Website. Your personal information may be used by those Service Providers in Australia and overseas to enable or improve the provision of services to Us. You hereby consent to such use of Your personal information.

We will not disclose information concerning You other than to our Service Providers, except with Your consent, or where required or authorised by law.  Personal information collected through the Website and which is no longer required by Us, nor required by law to be retained, will be destroyed in accordance with applicable laws.

Access to and correction of personal information

The University of Sydney’s privacy website includes forms to seek access to and correct personal information. If you require more information about your rights in relation to your personal information held by the University of Sydney or if you wish to make a complaint about the way the University of Sydney has handled your personal information, please contact the University of Sydney Privacy Officer. You are able to make a formal complaint under the Privacy Legislation.

Liability

To the maximum extent permitted by law, You assume full responsibility for any loss that results from Your use of the Website and any printing or downloads from the Website. We are not liable for any loss, claim, expense or injury or any damages, whether direct or indirect special or consequential (including loss of profits) under any circumstances, even if they are based on negligence or We have been advised of the possibility of those damages.

Indemnity

You agree to indemnify and hold each of The University of Queensland and The University of Sydney (Us) harmless from and against any and all claims, liability, losses, costs and expenses (including solicitor’s fees on a solicitor own client basis) incurred by Us [or any third parties claiming through us] in connection with any use or alleged use of the Website by You or through the use of Your password by any person, whether or not You authorised the use by that person.

Communications from the My Whiplash Navigator Website to Registered Users

The Website distributes specific communications such as technical service announcements, administrative messages, screening questions, treatment information via Website notifications, to registered users.  We assume all communications sent to Your registered contact information (email, address, mobile number, phone number) recorded in the Website have been received.

Registered User’s Account Suspension

In the event of any suspicion that the safety and integrity of Your (as a Registered User) account with the Website has been compromised by a third party, extended periods of inactivity, requests by law enforcement or other government agencies or if You have violated these Terms , Your account may be suspended by Us without notice.  Prior to suspension of your account a notification will be sent to Your registered email and You will have 30 days in which to raise any objections via email to such suspension and/or request reinstatement.  You may request your account be suspended at any time which will cease access to and communications from the Website.

The words in these Terms have the defined meaning below:

We Us and Our means The University of Sydney and The University of Queensland severally.

You and Your means the persons using the Website.

Intellectual Property Rights means all registered and unregistered rights in relation to present and future copyright, trademarks, designs, know-how, patents, confidential information and all other intellectual property as defined in article 2 of the Convention establishing the World Intellectual Property Organisation 1967.

Third Party Website means a website which is not under the control of The University of Sydney or The University of Queensland but which links to the Website.
